Welcome to LUMI Move.
These Terms of Service (“Terms”) apply to your use of the LUMI Move website, online store and related services.
LUMI MOVE PTE. LTD. (“LUMI Move”, “we”, “us” or “our”) operates this store and website, including all related information, content, features, tools, products and services (collectively, the “Services”). Our online store is powered by Shopify, which enables us to provide the Services to you.
These Terms, together with any policies referenced in them, describe your rights and responsibilities when you access or use the Services or purchase products from us.
Please read these Terms carefully. By visiting, interacting with or using our Services, including placing an order, you agree to these Terms and our Privacy Policy. If you do not agree, you should not use the Services.
Nothing in these Terms excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded under applicable consumer law.
SECTION 1 – ACCESS AND ACCOUNTS
You must be at least 18 years old, or otherwise have legal capacity to enter into a binding contract, to place an order through our Services.
When using the Services or placing an order, you may be asked to provide information including your name, email address, billing details, payment information and shipping address. You agree that the information you provide is accurate, current and complete.
If you create an account, you are responsible for maintaining the confidentiality and security of your account credentials and for activity conducted through your account.
You must not use the Services for any unlawful, fraudulent or unauthorised purpose.
SECTION 2 – OUR PRODUCTS
We make reasonable efforts to ensure that product descriptions, photographs, colours, measurements and other information displayed on our website are accurate.
However, colours and appearance may vary slightly depending on your screen, device settings, lighting and normal manufacturing variations.
Sizing and Fit
Our size guides are designed to help you select the most appropriate size for your child. Children’s feet vary in length, width and shape, and individual fit may differ between children and between LUMI Move styles.
Our Princess Shoes and Jelly Shoes may use different sizing and fit specifications. We therefore recommend measuring your child’s feet and referring to the size guide for the specific style you are purchasing rather than relying solely on their usual shoe size.
Sizing information is provided as a fit guide and does not guarantee an identical fit for every child.
Please regularly check that children’s footwear continues to fit comfortably as children’s feet grow.
Product Information
Our footwear is designed for ordinary everyday footwear use. Product descriptions relating to fit, flexibility, natural movement or other design features are general product information and are not medical or healthcare advice.
We may update product descriptions, specifications or designs from time to time, provided this does not affect orders already accepted except where reasonably necessary or agreed with you.
We reserve the right to discontinue products or limit quantities available for purchase.
SECTION 3 – ORDERS
When you place an order through our store, you are making an offer to purchase the selected products.
We reserve the right to accept, decline or cancel an order where reasonably necessary, including where a product is unavailable, there is an error in pricing or product information, payment cannot be processed, we reasonably suspect fraud or unauthorised activity, or we are unable to deliver to the address provided.
If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled item or order to your original payment method where reasonably possible.
Please review your order carefully before submitting it. Once an order has entered processing or fulfilment, we may not be able to change or cancel it.
We may contact you using the email address, phone number or other contact details you provide in connection with your order.
Products purchased from our consumer store are intended for personal or household use and not for unauthorised commercial resale.
SECTION 4 – PRICES, PAYMENT AND PROMOTIONS
Unless otherwise indicated, prices displayed on our Singapore store are in Singapore Dollars (SGD).
The price charged will be the price shown when your order is placed, subject to correction of genuine errors as described in these Terms.
Any applicable taxes, delivery fees or other charges will be disclosed where required before you complete your purchase.
Prices, promotions and product availability may change from time to time.
We may offer launch prices, promotional offers, discount codes or other special offers. Any specific conditions stated in connection with a promotion form part of these Terms for that promotion.
Where a promotion is advertised for a stated period, availability may also be subject to stock levels.
You agree to provide accurate and current billing and payment information and confirm that you are authorised to use the payment method submitted with your order.
SECTION 5 – SHIPPING AND DELIVERY
Shipping and delivery are governed by our Shipping & Delivery Policy, as published on our website.
Delivery timeframes are estimates unless expressly stated otherwise. Delays may occasionally occur due to circumstances outside our reasonable control, including courier delays, weather, service disruptions or other unforeseen events.
We will make reasonable efforts to dispatch and deliver orders within the timeframes communicated to you.
You are responsible for providing a complete and accurate delivery address. Please contact us as soon as possible if you discover an error in your delivery information.
Unless otherwise required by applicable law, risk of loss or damage to the products passes to you upon delivery to the delivery address provided with your order.
SECTION 6 – EXCHANGES, STORE CREDIT AND FAULTY ITEMS
Purchases are subject to our Exchanges & Store Credit Policy, as published on our website.
For eligible change-of-mind, size or colour requests, we may offer an exchange or store credit in accordance with that policy.
We do not provide refunds to the original payment method for change-of-mind purchases unless required by applicable law.
Items returned for an exchange or store credit must satisfy the eligibility requirements stated in our Exchanges & Store Credit Policy, including applicable timeframes and requirements relating to condition and original packaging.
If an item is faulty, damaged, not as described, or you receive an incorrect item, please contact us as soon as possible.
Nothing in these Terms or our Exchanges & Store Credit Policy excludes, restricts or modifies any rights or remedies you may have under applicable consumer law, including rights relating to goods that do not conform to the contract.
SECTION 7 – INTELLECTUAL PROPERTY
The Services and their content, including the LUMI Move name and logo, product names, designs, text, graphics, illustrations, photographs, videos, website design and other materials, are owned by or licensed to LUMI MOVE PTE. LTD. and are protected by applicable intellectual property laws.
You may use the Services for personal, non-commercial purposes only.
Unless expressly permitted by us, you may not reproduce, copy, distribute, modify, publish, display, sell, license or commercially exploit any part of the Services or our intellectual property without our prior written permission.
LUMI Move, our logos, product designs and associated branding may not be used without our prior written consent.
Shopify and any other third-party names, logos and trademarks appearing through the Services belong to their respective owners.
All rights not expressly granted under these Terms are reserved.
SECTION 8 – OPTIONAL TOOLS AND THIRD-PARTY SERVICES
We may provide access to tools, applications or services operated by third parties.
We do not control all third-party tools and services and cannot guarantee their availability, performance or content.
Your use of third-party services may also be subject to the third party’s own terms and privacy policies.
To the extent permitted by law, we are not responsible for loss or damage arising solely from your independent use of third-party services that are not controlled by us.
We may introduce new tools, features or functionality to the Services from time to time, which will also be subject to these Terms where applicable.
SECTION 9 – THIRD-PARTY LINKS
Our Services may contain links to websites, social media platforms or other services operated by third parties.
We do not control those third-party websites and are not responsible for their content, privacy practices, security or availability.
If you leave our Services to visit a third-party website, you should review that third party’s terms and privacy policy.
Any complaint regarding goods or services purchased directly from a third party should be directed to that third party.
SECTION 10 – RELATIONSHIP WITH SHOPIFY
Our online store is powered by Shopify.
However, products purchased from our store are sold to you by LUMI MOVE PTE. LTD., not Shopify.
Shopify provides technology and ecommerce services that enable us to operate the store but is not the seller of LUMI Move products.
Your personal information may also be processed by Shopify as described in our Privacy Policy and Shopify’s applicable privacy notices.
Nothing in this section excludes any liability or responsibility that cannot lawfully be excluded.
SECTION 11 – PRIVACY
Our collection, use and disclosure of personal information is governed by our Privacy Policy.
Because our online store is hosted by Shopify, Shopify also processes certain information relating to your access to and use of our Services.
We also use service providers such as Klaviyo and other providers to support functions including email marketing, payments, analytics, fulfilment and delivery, as described in our Privacy Policy.
Please review our Privacy Policy for more information about how personal information is handled and how you may exercise your privacy rights.
SECTION 12 – REVIEWS, FEEDBACK AND USER CONTENT
If you submit a review, photograph, suggestion, comment, idea or other content to us (“Feedback”), you confirm that you have the right to provide it.
Unless otherwise agreed, you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, publish and display Feedback for purposes connected with operating, improving and promoting LUMI Move and our Services.
We will not knowingly use content in a manner that violates applicable law or another person’s rights.
You must not submit content that infringes another person’s intellectual property, privacy or other rights; is unlawful, defamatory, abusive or misleading; contains malicious software or code; or falsely represents your identity or relationship with another person.
You remain responsible for the accuracy and legality of Feedback you submit.
SECTION 13 – ERRORS, INACCURACIES AND OMISSIONS
Occasionally, our website may contain typographical errors, inaccuracies or omissions relating to matters such as product descriptions, pricing, promotions, availability, delivery charges or delivery estimates.
We may correct genuine errors and update information at any time.
If an error materially affects an order you have already placed, we will contact you where appropriate.
If we are unable to fulfil your order because of an error and cancel the affected item or order after payment has been taken, we will refund the relevant amount to your original payment method where reasonably possible.
Nothing in this section permits us to make misleading representations or removes your rights under applicable law.
SECTION 14 – PROHIBITED USES
You may use the Services only for lawful purposes.
You must not use the Services for any unlawful or fraudulent purpose; to infringe our intellectual property rights or the rights of another person; to harass, threaten, abuse or harm another person; to transmit false or deliberately misleading information; to send spam, malicious code, viruses or other harmful technology; to improperly collect or track personal information belonging to others; to scrape, crawl or interfere with the Services in an unauthorised or disruptive manner; to circumvent security features; to impersonate another person or organisation; or to interfere with another person’s use or enjoyment of the Services.
We may restrict or suspend access to the Services where we reasonably believe these Terms have been breached.
SECTION 15 – TERMINATION
You may stop using the Services at any time.
We may suspend or terminate access to some or all of the Services if you materially breach these Terms, misuse the Services or engage in unlawful or fraudulent activity.
Termination does not affect rights or obligations that arose before termination.
Provisions which by their nature should continue after termination, including those relating to intellectual property, liability, privacy and governing law, will continue to apply.
SECTION 16 – WEBSITE INFORMATION AND DISCLAIMERS
We aim to keep the Services accurate, secure and available, but we cannot guarantee that the website will always operate without interruptions, delays or errors.
Information provided through the Services is intended for general information relating to our products and business and should not be treated as professional medical or healthcare advice.
To the fullest extent permitted by applicable law, the website and digital Services are provided on an “as available” basis.
Nothing in these Terms excludes, restricts or modifies any guarantee, warranty, condition, right or remedy that cannot legally be excluded or restricted under applicable law.
SECTION 17 – LIMITATION OF LIABILITY
Nothing in these Terms excludes or limits any liability that cannot legally be excluded or limited under applicable law.
To the fullest extent permitted by law, LUMI Move will not be liable for indirect, incidental, special or consequential loss arising from your use of the Services where such loss was not reasonably foreseeable.
Nothing in these Terms is intended to exclude or restrict your statutory consumer rights, liability for fraud or fraudulent misrepresentation, liability that applicable law does not permit us to exclude or restrict, or any remedy available to you in relation to defective or non-conforming goods that cannot legally be excluded.
Where our liability can lawfully be limited, it will be limited only to the extent permitted by applicable law.
SECTION 18 – INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify LUMI MOVE PTE. LTD. against reasonable losses, liabilities and costs arising from a third-party claim caused directly by your unlawful use of the Services, your material breach of these Terms or your infringement of another person’s rights.
This section does not apply to loss caused by our own breach, negligence or unlawful conduct.
SECTION 19 – SEVERABILITY
If any provision of these Terms is determined to be unlawful, invalid or unenforceable, that provision will be enforced to the maximum extent permitted by applicable law or, where necessary, severed from these Terms.
The remaining provisions will continue in full force and effect.
SECTION 20 – WAIVER AND ENTIRE AGREEMENT
If we do not immediately exercise or enforce a right under these Terms, this does not mean that we waive that right.
These Terms, together with the policies expressly incorporated or referenced in them, constitute the agreement between you and us concerning your use of the Services and purchases made through our online store.
Nothing in these Terms limits any representations, rights or obligations that cannot lawfully be excluded.
SECTION 21 – ASSIGNMENT
You may not transfer or assign your rights or obligations under these Terms without our prior written consent, except where applicable law gives you a right to do so.
We may assign or transfer our rights and obligations in connection with a legitimate transfer, restructuring or sale of our business, subject to applicable law.
SECTION 22 – GOVERNING LAW
These Terms and any contract formed between you and LUMI MOVE PTE. LTD. are governed by the laws of the Republic of Singapore, without prejudice to any mandatory consumer protections that may apply.
The courts of Singapore will have jurisdiction in relation to disputes arising from these Terms or the Services, subject to any rights or dispute-resolution mechanisms available under applicable law.
SECTION 23 – HEADINGS
The headings used in these Terms are for convenience only and do not affect their interpretation.
SECTION 24 – CHANGES TO THESE TERMS
You can review the current version of these Terms on this page at any time.
We may update these Terms from time to time to reflect changes to our Services, policies, business practices or applicable laws.
Where required by applicable law, we will provide appropriate notice of material changes.
Changes will not retrospectively alter the terms applicable to an order already accepted unless required by law or agreed with you.
Your continued use of the Services after updated Terms take effect constitutes acceptance of those updated Terms.
